Trainz - The Gym, Reimagined

By accessing or using our App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. We may update these Terms from time to time, and we will notify you of any significant changes. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

2. Eligibility

You must be a registered member of to use this App. By using the App, you represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction) and capable of entering into a binding agreement.

3. User Accounts and Registration

To use certain features of the App, you will need to create an account. You agree to:

Maintain the security of your password and identification.
Accept all risks of unauthorized access to your account and the information you provide.

The App allows you to post workout videos, photos, comments, and other content ("User Content"). You retain all rights in, and are solely responsible for, the User Content you post to the App.

By posting User Content, you grant Trainz and a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, display, reproduce, modify, create derivative works, perform, and distribute your User Content on and in connection with the App and the promotion of the App or .

You agree not to post, upload, transmit, distribute, store, create or otherwise publish through the App any of the following:

User Content that is unlawful, libelous, defamatory, obscene, pornographic, indecent, lewd, suggestive, harassing, threatening, invasive of privacy or publicity rights, abusive, inflammatory, fraudulent, or otherwise objectionable.
User Content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law.
User Content that may infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any party.
User Content that impersonates any person or entity or otherwise misrepresents your affiliation with a person or entity.
Unsolicited promotions, political campaigning, advertising, or solicitations.
Private information of any third party, including, without limitation, addresses, phone numbers, email addresses, Social Security numbers, and credit card numbers.
Viruses, corrupted data, or other harmful, disruptive, or destructive files.
User Content that, in the sole judgment of Trainz or , is objectionable or which restricts or inhibits any other person from using or enjoying the App, or which may expose Trainz or or its users to any harm or liability of any type.

We reserve the right, but are not obligated, to remove or edit any User Content for any reason.

5. Community Guidelines and Conduct

You agree to use the App in a respectful and appropriate manner. This includes, but is not limited to:

Respectful Interaction: Engage with other members respectfully. Harassment, bullying, hate speech, or any form of derogatory comments are strictly prohibited.
Appropriate Content: Ensure your shared content is suitable for a general audience and gym environment.
No Spamming: Do not post repetitive or unsolicited content.
Fair Play in Challenges: Participate in challenges honestly and according to the rules set by . Any attempt to manipulate results or cheat will lead to disqualification and potential account suspension.

6. Leaderboards and Rewards

The App features leaderboards based on gym attendance (stars) and participation in challenges.

Stars: Stars are awarded for consistent gym attendance as tracked by . The awarding of stars and your ranking on leaderboards are subject to the sole discretion of .
Challenges and Prizes: may offer challenges within the App with potential prizes (e.g., protein powder sponsored by vendors). Participation in challenges is voluntary. Prizes are awarded at the sole discretion of based on challenge rules. Prizes are non-transferable and may be subject to availability. Trainz is not responsible for the fulfillment, quality, or any issues related to sponsored prizes. Any claims regarding prizes should be directed to .

7. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of Trainz and its licensors. The App is protected by copyright, trademark, and other laws of both United Arab Emirates and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Trainz.

8. Disclaimers

The App is provided on an "AS IS" and "AS AVAILABLE" basis. Trainz and make no warranties, express or implied, regarding the App, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Trainz and do not warrant that:

The App will function uninterrupted, securely, or be available at any particular time or location.
Any errors or defects will be corrected.
The App is free of viruses or other harmful components.
The results of using the App will meet your requirements.

9. Limitation of Liability

In no event shall Trainz, , nor their directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the App.
Any conduct or content of any third party on the App.
Any content obtained from the App.
Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

10. Indemnification

You agree to defend, indemnify, and hold harmless Trainz, and their licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

Your use and access of the App, by you or any person using your account and password.
A breach of these Terms.
User Content posted on the App.

11. Termination

We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the App. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of United Arab Emirates / Dubai, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the App.
